Terms of Service

AI Photo Generator (“the Service”) is operated by Upward Growth Technology LLC, a limited liability company registered in Wyoming, USA (“we”, “us”).

By using the Service you agree to these Terms. Please read them carefully before you generate or download any image. If you don’t agree, please don’t use the Service.

You must be at least 13 years old to use the Service. If you are under 18, you may use it only with the permission of a parent or legal guardian.

The Service lets you generate images from text prompts you write. You can use it without creating an account.

You are responsible for the prompts you write and for how you use the images you generate. We may change, suspend or discontinue any part of the Service at any time.

You may not use the Service to request, generate, or attempt to generate images involving:

• Sexual content involving minors
• Non-consensual sexual content
• Graphic violence or gore
• Hate speech, or content that promotes hatred against a protected group
• Harassment or bullying of a real person
• Self-harm or suicide
• Impersonation of a real, identifiable person without their consent
• Any other illegal activity

Violating this policy may result in your access being blocked without notice.

Prompts and generated images are automatically screened by moderation systems, both before and after generation.

If something is flagged as violating these Terms, the Service may block the prompt, refuse to return an image, or remove an image that was already generated. This can happen even if the flag turns out to be a false positive.

Generated images are stored for 30 days from creation and are then permanently deleted. Please download any image you want to keep before the 30-day window closes.

How you may use an image depends on the plan it was made on, as described in the next section.

Pro accounts that consistently exceed the fair-use limit may be rate-limited or asked to move to a custom plan.

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including as to accuracy, availability, or fitness for a particular purpose. We do not guarantee that any generated image will be free of errors, artifacts, or content you did not intend.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages arising from your use of the Service, and our total liability for any claim is limited to the greater of US$100 or the amount you paid us for the Service in the 12 months before the claim. Some jurisdictions don’t allow these limits, so they may not apply to you.

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Wyoming, and you consent to their jurisdiction.

We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page. If you keep using the Service after a change, you accept the updated Terms.
